MINUTES OF THE REGULAR BOARD MEETING

on July 19, 2006

The Ulster County Resource Recovery Agency held a Budget Workshop on July 19, 2006 at 999 Flatbush Avenue, Kingston, NY.

Roll Call for the Budget Workshop was at 2:00pm.

The following Board members were present: Kevin Roberts, Catherine Nilsen, Dennis Helm and Arnold Bernardini. Leon Smith was absent.

Also present were: Michael Bemis, Executive Director; Frank Tomaseski, Controller and Stephen J. Wing, Agency Counsel and Secretary.

The proposed 2007 agency budget, previously sent to the members of the Board, was presented by Executive Director Bemis and Controller Tomaseski, and discussed by the Board. The Board reached consensus on the 2007 budget and agreed to consider it formally at the regular meeting to be convened after the workshop. Whereupon, the Board adjourned the workshop.

APPROVAL OF MINUTES

The Minutes of the June 21, 2006 Regular Board meeting were MOVED to the floor by Dennis Helm and seconded by Catherine Nilsen. Four in favor. None opposed. One Absent (Smith).

COMMUNICATIONS & ANNOUNCEMENTS

The next Regular Monthly Business Meeting was scheduled for Wednesday, August 16, 2006 at 3:00pm.

The next Environmental Committee Meeting has been scheduled for Wednesday, August 16, 2006 at 3:30pm at the Ulster County Resource Recovery Agency offices.

GENERAL REPORTS

The Board received and reviewed the MSW Tonnage Report, the Recycling Tonnage Report and the Leachate Collection Report for January thru June, 2006.

FINANCIAL MATTERS

Resolution No. 2028 Re: Approving Transfer from the Bond Redemption and Improvement Fund to the Operating Reserve;

This Resolution authorizes and approves the transfer of $150,000 from the Bond Redemption and Improvement Fund to the Operating Reserve for unexpected costs in connection with removal of material pursuant to DEC’s requirements..

Resolution No. 2028 was MOVED to the floor by Dennis Helm and seconded by Arnold Bernardini. Four in favor. None opposed. One Absent (Smith).

Resolution No. 2029 Re: Authorization of Proposed 2007 Agency Budget;

This resolution authorizes the Executive Director to forward the proposed 2007 Agency Budget to the Ulster County Legislature for their review in accordance with the terms of the County Service Agreement.

Resolution No. 2029 was MOVED to the floor by Dennis Helm and seconded by Arnold Bernardini. Four in favor. None opposed. One Absent (Smith).

Board Notification - Mike Bemis notified the Board of the Notice of Default letter sent to the Town of Plattekill.

ADMINISTRATIVE MATTERS

Board Notification - Mike Bemis notified the Board that the Environmental Committee was requesting a meeting with the Board of Directors on August 2, 2006 at 3:30pm.

EXECUTIVE SESSION

It was MOVED by Dennis Helm and Seconded by Arnold Bernardini to go into executive session to discuss credit history of a corporation and litigation. Four in favor. None opposed. One Absent (Smith).

Minutes of the executive session and the action taken are to be maintained by the Secretary in a confidential file.
